We, LD DIDACTIC GmbH, Leyboldstr. 1, 50354 Hürth, Germany, (“LD”), take the protection of your personal data very seriously in conjunction with the use of the company websites of www.ld-didactic.de or www.ld-didactic.com and the online shops www.leybold-shop.de or www.leybold-shop.com, www.leybold-shop.at, www.feedback-shop.co.uk and www.leybold-shop.fr (all collectively and individually referred to as “websites”).

The www.ld-didactic.de and www.ld-didactic.com domains are editorial and the leybold-shop domains and the feedback-shop domain are used to present our range of products with the potential acquisition or request for a proposal for the products and solutions. Since the designs are very similar, we provide a uniform data privacy policy for all of the websites.

Which personal data we process depends on how you use the websites:

With this data privacy policy, we provide information about the type, scope and purpose of the personal data we collect, use and process. This data privacy policy also explains your rights to you. The following data protection provisions apply to the use of our websites and our online registration service and govern the collection, processing and use of the data.

You can use the LD websites in a variety of ways. You will receive detailed information on all possible uses in the further course or you can simply click on the relevant item in the following overview and jump directly to it.

Overview of possible uses: You can, for instance, visit the websites to get general information about the products we sell. You can also register with our online shop and purchase the products offered there (“Online Shop”), download materials and software (“Download Center”) or contact us after registering. You can also register to receive regular information via e-mail about LD and our products and solutions.

We process and use your personal data to process your orders, inform you of our newest offers, provide you materials and software and optimise the websites for you. The data is always processed and used in compliance with the General Data Protection Regulation and in accordance with the country-specific data protection provisions applicable to LD.

You can also use the websites without providing us or otherwise leaving behind personal data, if you deactivate cookies. Please note that you may not be able to use all of the functions on the website in this case. The websites use cookies to present the online portfolio, make the websites available, for statistical purposes and to analyse the performance of the websites.

We do not pass on any personal data to third parties except our order processors in accordance with Art. 28 of the GDPR and our dispatch services.

We are a B2B (business-to-business) provider. That means we only have business relationships with companies, public institutes and public administrations. Consumers in accordance with Sec. 13 of the BGB (German Civil Code) are not thus permitted to order from our online shops. This is also clearly stated in our General Terms and Conditions. In addition, customer must be entitled to place an order in the name and for the account of the specified account. Furthermore, persons under 16 years of age are not permitted to utilise our services. This includes registration and ordering.

LD has implemented several technical and organisational measures to handle the processing in order to offer the most consistent protection possible of personal data processed via these websites. To protect the security of your data during transmission, we use encryption procedures that meet the current state-of-the-art (i.e. SSL) via HTTPS. Still, Internet-based data transfers can have security gaps, making it impossible to guarantee complete protection. For this reason, you are free to provide us personal information in an alternative manner. For instance, on the telephone.

II. What personal data do we collect and how do we use it?

“Personal data” includes all information that pertains to an identified or identifiable natural person. A natural person is considered identifiable if they can be directly or indirectly identified, in particular by means of an assignment of a designation, such as a name, ID number, location data, online ID, or of one or more special characteristics that express the physical, physiological, genetic, psychological, financial, cultural or social identity of this natural person.

Processing includes any procedure executed with or without the help of automated processes or any such series of procedures in conjunction with personal data such as the collection, recording, organisation, sorting, saving, adjustment or modification, reading out, querying, using, disclosure via transmission, distribution or another form of provision, comparison or linking, restriction, deletion or destruction.

Whether and which personal data we collect, process and utilise (collectively referred to as “processing”) depends on how you use our websites:

1. Surfing on our websites

1.1   Collection of general data and information

LD’s websites record a variety of general data and information every time you or an automated system goes to the website. This general data and information is saved in the server’s log files. The following may be recorded: (1) browser types and versions, (2) the operating system used by the accessing system, (3) the website from which an accessing system was referred to our website (referrer), (4) the subpages an accessing system can access on our websites, (5) the date and time of the access to the websites, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing system and (8) other similar data and information that serves to prevent risks in the event of attacks on our IT systems.

When using this general data and information, LD does not draw any conclusions regarding the relevant person. This information is, in fact, required to (1) correctly display the contents of our websites, (2) optimise the contents of our websites, (3) ensure the continuous functionality of our IT systems and the technology used by our websites, and (4) to provide criminal investigative authorities information required for a criminal investigation in the event of a cyber-attack. LD therefore statistically evaluates the data and information collected and evaluates it with the objective of increasing data protection and data security at our company to ultimately ensure the optimum level of protection of the personal data we process. The data in the server log files is stored separately from all personal data provided by a person. The legal basis for data processing is Sec. 6 para. 1 lit. f GDPR. Our justified interest follows from the purposes listed above for data collection. The data will be deleted as soon as they are no longer necessary to achieve the purpose for which they were collected. This is the case after seven days at the latest. Further storage is possible. In this case, the IP addresses of the users are deleted or shortened, so that an assignment of the client is no longer possible.

1.2   Collection of personal data

It is, in principle, possible to visit our websites without your personal data being processed if you have denied the use of cookies. You may not be able to use all of the functions on the website in this case. Please read our declaration for information about the use of cookies (here). We use the navigation information (data about your computer and visit to our website, in particular, your location, the browser you are using, referral source, length of your visit and the pages you opened) to improve your browser use, to personalise the websites and improve the registration services.

2. Contact options

If you use contact forms on our websites or otherwise contact us electronically (for instance via email), we will save and process your personal data. You can use this channel to ask us questions about our products, your orders or other questions about LD, or submit comments. Personal data you voluntarily provide us will be saved for processing purposes or so we can contact you as well as for possible follow-up questions. For this purpose, we process your following details: last name, first name, address, telephone number, fax number, email address, your message, which you provide us in accordance with your preferences as we can derive them from your query. This personal data will not be passed on to third parties.

In addition, we have placed an online service portal form and a repair service form on our websites, which you can open and fill out online and send to us with your return. Such personal data transmitted by you to us on a voluntary basis will be stored for the purpose of processing or contacting you and for possible follow-up questions. For this purpose we process your personal data, such as last name, first name, email address, school/institution, address data of school/institution, as well as other information on the respective purpose of contacting us, as you can see in the individual forms.

The data specified and sent to us in the contact form, service forms and via email is processed based on Sec. 6 para. 1 lit. f GDPR. Our justified interest serves the purpose of processing your sent contact enquiry. If you contact us to request an offer or return an order, the data entered in the contact form will be processed to carry out pre-contractual contractual measures based on Sec. 6 para. 1 lit. b GDPR.

The data you entered in the contact form will remain with us until you request they be deleted, revoke your consent to the data being stored or the reason for the data being stored no longer applies (e.g. after your request has been processed). Mandatory statutory provisions, in particular retention periods, remain unaffected.

3. Orders and downloading catalogues, software, etc.

3.1 Orders of printed materials

In the “Catalogues” section, you can order current brochures and product catalogues as a printed edition. We process the following personal data for this purpose: last name, first name, title, job, school/institute/company, school type, department, faculty department, customer no., address (private and/or business), telephone number, fax number, email address. Data that is mandatory to deliver or process the order will be passed on to third-party service providers.

The data specified and sent to us in the order form is processed based on Sec. 6 para. 1 lit. f GDPR. Our justified interest of the data processing of your personal data follows from the purpose of processing and handling of your order of print materials.

The data you entered in the contact form will remain with us until you request they be deleted or the reason for the data being stored no longer applies (e.g. after your request has been processed). Mandatory statutory provisions, in particular retention periods, remain unaffected.

3.2 Download via registration service - Download Center

You can also register for our “Download Center” registration service to download free current flyers, brochures, catalogues and software from us and learn more about our company and our products. Our registration service to use personalised services collects the following personal data: last name, first name, email address, country, product interest which we process for this purpose. Once you have registered with us, you can access content and services we only offer registered users. We will only collect and save the personal data you have provided us solely for our own purposes. LD accepts no liability for password misuse, unless this was caused by us.

By registering on our websites, the IP address your Internet service provider (ISP) assigns, the date and the time of the registration will be saved. This data is saved because it is the only way to prevent misuse of our services and this data can assist in clarifying criminal acts where necessary. In view of this, it is necessary to save this data as a backup. This data will not be passed on to third parties unless there is a statutory obligation to pass it on or it is passed on for criminal prosecution purposes. To protect the security of your data during transmission, we use encryption procedures that meet the current state-of-the-art (i.e. SSL) via HTTPS.

You have the option to modify or delete the data provided during registration at any time if needed unless prohibited by statutory retention periods. Of course, we will provide you information about the personal data we save about you at any time. We will gladly correct or delete this data upon your request. The data specified and sent to us during registration is processed based on Sec. 6 para. 1 lit. b GDPR, which allows the processing of data in order to execute pre-contractual measures, and Sec. 6 para. 1 lit. f GDPR. Our justified interest of the data processing of your personal data follows from the purpose of the provision of the downloads of our catalogues, brochures and software requested by you.

The downloads will be tracked for statistical evaluations of the success or failure of catalogues and software developments. LD will save and evaluate such personal data, collected via cookies, to optimise and prioritise the catalogue and software projects. This personal data will not be passed on to third parties.

The legal basis for the collection and processing of this statistical data for analytical purposes is Sec. 6 para. 1 lit. f GDPR. The LD has a justified interest in analysing the user behaviour to optimise this online offer and service.

The data will be deleted as soon as it is no longer necessary to achieve the purpose of its collection and the registration for the Download Center is cancelled or modified.

4. Online shops

4.1 Online shops with a direct ordering option: www.leybold-shop.de, www.feedback-shop.co.uk and www.leybold-shop.at

Please notice that the direct ordering is only possible for visitors from the countries for which the online shop is set up (www.leybold-shop.de - Germany, www.leybold-shop.at - Austria, www.feedback-shop.co.uk - United Kingdom). For all other countries, the offer functionality is displayed as described in 4.2.

In order to be able to place orders via the online shop, every customer must set up a password-protected customer account.

We collect your personal data, which you enter when registering for our online shop or place an order or retroactively update or add to your user account or the contact options specified there. We process the following personal data for this purpose: customer number, salutation, title, first name, last name, job title, name of your school/institute/company, IP address, faculty department, branch, business address (billing and shipping address), email address, telephone number, fax number, tax/VAT number, purchase order number, information about the order and its processing as well as your order history. The data you have provided is required to fulfil the contract or execute pre-contractual measures. We process your personal data for this purpose. We cannot conclude the agreement with you without this data.

Our online shops are pure B2B online shops from which consumers cannot and are not permitted to order. We therefore actively ask, during each order, whether the purchaser is a business customer and not a consumer in accordance with Sec. 13 of the BGB (German Civil Code). This is also clearly stated in our General Terms and Conditions. In addition, customer must be entitled to place an order in the name and for the account of the specified account. Furthermore, persons under 16 years of age are not permitted to order.

We only process personal data to process your orders and respond to your questions. This is done on the basis of Sec. 6 para. 1 lit. b GDPR, which permits the processing of data to fulfil a contract or pre-contractual measures.

After making a purchase from our online shop, we use the email address you provided in conjunction with the purchase for advertising and recommendations for our own or similar products via email. This is how we provide you with recommendations which might interest you based on your recent purchases. You will receive these emails even if you do not register for a newsletter. Of course, we strictly comply with the statutory specifications (Sec. 7 para. 3 of the UWG (Unfair Competition Act). If you no longer wish to receive recommendations via email, you can object at any time. You will not incur any further transmission costs beyond those in accordance with the base rates. The legality of your consent to the processing up to the revocation remains unaffected. To do this, you will find an unsubscribe link in every email recommendation. We use cookies to collect personal data during the ordering process and if you place articles in the shopping cart. We also process this data in an aggregated form to improve our product range, the online shop and the websites. To learn more about data processing using cookies during the ordering process, please click here. The legal basis for the processing of the cookies is Art. 6 para. 1 lit. f DSGVO. The LD has a justified interest in analysing the user behaviour to optimise its online offers and the technically fault-free and optimised presentation of all services as well as the functions you require, such as the shopping cart functionality.

Data that is mandatory to deliver or process the order will be passed on to third-party service providers. This includes transport companies/dispatch companies we commission to deliver the goods as well as all authorities or other public bodies, insurance carriers, etc., towards which statutory information obligations exist.

The criterion for the duration of the retention of personal data is the respective statutory retention period. After the retention period, the relevant data is routinely deleted if it is no longer required to fulfil or initiate a contract.

The LD does not assume any liability for the misuse of passwords unless caused by us.

Naturally, you have the option to modify or delete the user account data at any time if needed unless prohibited by statutory retention periods. The domain www.leybold-shop.com and www.leybold-shop.fr do not have a direct ordering option. You can request a proposal for the products, experiments and equipment set-ups using the “Send me an offer” (FR: " M’envoyer une offre ")service. For this purpose, we process the following personal data: last name, first name, the name of the school/institution, department, address, telephone number, product interest and the email address, which you provide us in accordance with your preferences as we can derive them from your query. The data you have provided is required to execute pre-contractual measures. We process your request either ourselves or pass it on to one of our authorised distributors responsible for the distribution of our products in the respective country from which the request originates and who processes the data on our behalf solely for the purpose of processing your request. The data specified and sent to us is processed based on Sec. 6 para. 1 lit. b GDPR, which allows the processing of data in order to execute a contract or pre-contractual measures.

We also collect personal data using cookies if you place articles on the product list and request a proposal. These cookies are saved and processed on the basis of Sec. 6 para. 1 lit. f GDPR. The LD has a justified interest in saving the cookies for analysing the user behaviour to optimise its online offers as well as for the technically smooth and optimised presentation of all functionalities, including the product list and offer functionality as requested by you.

The criterion for the duration of the retention of personal data is the respective statutory retention period. After the retention period, the relevant data is routinely deleted if it is no longer required to fulfil or initiate a contract.

5. Email marketing - Newsletter

You can subscribe to LD’s newsletter via our websites. If you have registered for our email newsletter via forms on our websites or requested the newsletter via email, we will process your email address, which you provided us, and other provided data to send the newsletter to you. We process this personal data to send you the newsletter with updates about the products from LD and our activities, each in compliance with applicable competition laws. For this purpose, we process the following personal data: first name, last name, salutation, product interest and email address, which you provide us in accordance with your preferences as we can derive them from your query. The data specified and sent to us during registration is processed based on your consent (Sec. 6 para. 1 lit. a GDPR).

We require a valid email address for an effective registration. To check that a registration has actually been executed via the owner of an email address, we use the double opt-in procedure and send you a confirmation email the first time you register.

When registering for our newsletter, we also save the IP address the Internet service provider (ISP) assigns to the computer system used by the relevant person and the date and time of the registration. This data has to be collected in order to track (potential) misuse of the email of an affected person at a later date.

We also use the email address after making a purchase from our online shop, which you provided in conjunction with the purchase for advertising and recommendations for our own or similar products via email. This is how we provide you with recommendations which might interest you based on your recent purchases. You will receive these emails even if you do not register for a newsletter. Of course, we strictly comply with the statutory specifications (Sec. 7 para. 3 of the UWG (Unfair Competition Act).

You can object to receiving our email newsletter at any time with effect for the future. For the purposes of revoking consent, there is an “unsubscribe” link at the end of every newsletter. There is also the option to unsubscribe from the LD newsletter via an email to marketing@ld-didactic.de, Subject: Unsubscribe from newsletter. Of course, you can also unsubscribe from the email newsletter at any time with effect for the future via post, telephone or fax (to obtain contact information, click here). You will not incur any further transmission costs beyond those in accordance with the base rates. The legality of your consent to the processing up to the revocation remains unaffected.

The LD newsletters are tracked for statistical evaluations of the success or failure of online marketing campaigns and contain so-called tracking pixels, which are miniature graphics. Based on the embedded tracking pixel, we can determine whether and when an email is opened and which of the links in the email were opened by the newsletter recipient. LD will save and evaluate personal data collected by such tracking pixels in the newsletters within the marketing software HubSpot (for more information click here) in order to optimise the distribution of the newsletter and adapt the content of future newsletters even better to the interests of the relevant person. These cookies are saved on the basis of Sec. 6 para. 1 lit. f GDPR. The LD has a justified interest in analysing of the user behaviour to optimise both the content of the newsletters.

Beyond that, we will not pass on your data to third parties unless we inform you separately. As far as we utilise service providers within the scope of contract data processing, your data are subject to the security standards specified by us in order to adequately protect your data.

6. Google Ads (previously: Google AdWords)

LD has integrated Google Ads (previously: Google AdWords) on the websites. Google Ads is an Internet advertising service that allows advertisers to place advertisements in Google’s search engine. Google Ads allows advertisers to define specific keywords in advance via which an advertisement can be exclusively displayed in Google’s search engine results if the user calls up a keyword-related search result using the search machine.

The operating company of the Google Ads services is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

The purpose of Google Ads is to advertise our websites by showing interest-related advertisements in the Google search engine search results.

If you get to our websites via a Google advertisement, a conversion cookie will be saved on your computer, laptop or similar device by Google. You can find an explanation of what cookies are here. A conversion cookie becomes invalid after thirty days and is not used to identify you personally. Each Google Ads customer receives a different cookie.

Until the cookie expires, the conversion cookie will track whether specific subpages such as the shopping cart were opened from an online shop system on our websites. Using conversion cookies, we and Google can also track whether a relevant person who got to our website via an Google Ads advertisement generated revenue, i.e. whether they purchased goods or cancelled the process.

The data and information collected using conversion cookies will be used by Google to create visitor statistics for our websites. We, in turn, use the visitor statistics to determine the total number of users who were referred to us via Google Ads advertisements, i.e. the success or failure of the respective Google Ads advertisement and optimise our Google Ads advertisements for the future. Neither our company nor other Google Ads advertising customers will receive information from Google that can be used to personally identify the respective person. Conversion cookies are saved on the basis of Art. 6 para. 1 lit. f GDPR. The LD has a justified interest in the analysis of the user behaviour to optimise both its online offer and its advertisements.

You can prevent the placement of cookies via the relevant settings in the browser and thus permanently prohibit their use. This can be done via the browser settings which generally deactivate the automatic placement of cookies or you can set your browser settings to block cookies from the domain “googleadservices.com”. Setting the browser settings in this manner also prevents Google from placing a conversion cookie on your IT system. A cookie placed by Google Ads can also be deleted at any time via the browser or another software programme. Please note that you are not can not to delete the opt-out cookies if you do not want measurement data to be recorded. If you delete all of the cookies in your browser, you will have to use the respective opt-out cookie again.

You also have the option to opt out of receiving the interest-based advertisements from Google. To do so you have to open the link from your browser and configure the desired settings there.

7. Applications and application processes

LD collects and processes the personal data of applicants for the purpose of completing the application process. The data can also be processed electronically. This is the case, in particular, if an applicant sends relevant application documents to LD via electronic means, e.g. via email or via an online form on the websites. If LD concludes an employment contract with an applicant, the transmitted data will be saved for the purpose of concluding the employment contract in compliance with the statutory regulations. If the party responsible for the processing does not conclude an employment contract with the applicant, the application documents will be automatically deleted four months after the hiring decision is announced as long as deletion does not oppose other justified interests of the party responsible for the processing. Other justified interests in this sense include, for instance, an obligation to provide evidence in legal proceedings in accordance with the Gleichbehandlungsgesetz (General Equal Treatment Act (AGG). The processing of the data specified and sent to us with the application is based on Sec. 6 para. 1 lit. b GDPR.

8. Online marketing activities with Hubspot

We use HubSpot for our online marketing activities. HubSpot is an integrated software solution with which we cover a variety of aspects of our online marketing.

This includes:

  • email marketing (newsletter and automated e-mails)
  • reporting (traffic sources, accesses, interaction KPIs with our newsletter/emails and websites)
  • contact management (user segmenting)
  • landing pages and contact forms

The personal data that we have received from you from the various forms of use of our websites (listed above in this data protection declaration) will be stored and processed on the servers of our software partner HubSpot for the above-mentioned purposes. We use this data to contact you and to determine which LD products and solutions are of interest to you. We use all collected information exclusively to optimize our marketing. The individual forms of use, such as newsletters, are explained separately in this data protection declaration with regard to data collection, data storage and data processing for your better understanding and are provided with a reference to HubSpot.

HubSpot cookies are saved on the basis of Sec. 6 para. 1 lit. f GDPR. The LD has a justified interest in analysing the user behaviour to improve our online offers and our advertising, and the technically fault-free and optimised presentation of all services and contents content for our users.

9. Usage of YouTube to show videos

We present videos on our websites using services provided by YouTube. YouTube is a video portal and operated by YouTube LLC with headquarters at 901 Cherry Avenue, San Bruno, CA 94066, USA. YouTube is represented by Google Inc. with headquarters at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

On YouTube, users can view, rate, comment on and upload videos for free. Over the last few years, YouTube has become one of the most important social media channels worldwide. To enable us to display videos on our website, YouTube provides a code snippet that we have integrated into our site.

We also use YouTube plugins on our leybold-shop websites and feedback-shop website. Usually your IP address is already sent to YouTube and cookies are installed on your computer when you visit a page with embedded videos. However, we have included our YouTube videos with a prior approval functionality. Therefore a direct connection with YouTube is not established and no information is sent and stored. If you click on "I agree", the content will be loaded and a connection is established with the YouTube servers and the plugin is shown. This provides the YouTube server with information about your IP address, which video you have viewed and the pages you have visited on our websites. If you are logged onto YouTube as a member, then YouTube will automatically assign this information to your personal user account. When you activate the plugin (e.g. by clicking the start button of a video), the corresponding information is likewise assigned to your user account. You can prevent the automatic assignment of this information by logging out of your YouTube account and other accounts operated by the companies YouTube LLC and Google Inc. and deleting their respective cookies before logging onto our websites.

On our websites ld-didactic and landing pages, the YouTube videos are either integrated as a link directly to YouTube or embedded via the code snippet mentioned above.When you call up a page on our website that has an embedded YouTube video, your browser automatically connects to the servers of YouTube or Google. Various data is transferred (depending on the settings). Google Ireland Limited (Gordon House, Barrow Street Dublin 4, Ireland) is responsible for all data processing in the European area.

As soon as you visit one of our pages that has a YouTube video embedded, YouTube at least sets a cookie that stores your IP address and our URL. If you are logged in to your YouTube account, YouTube can associate your interactions on our site with your profile, usually using cookies. This includes data such as session duration, bounce rate, approximate location, technical information such as browser type, screen resolution or your internet service provider. Other data may include contact information, any ratings, sharing content via social media or adding to your favourites on YouTube.

If you're not signed in to a Google Account or YouTube account, Google stores data with a unique identifier associated with your device, browser or app. For example, your preferred language setting is retained. However, much interaction data cannot be stored because fewer cookies are set.

In the linked list (HERE) we show cookies that were set in a test in the browser. On the one hand, we show cookies that are set without a registered YouTube account. On the other hand we show cookies that are set with a registered account. The list cannot claim to be complete, because user data always depend on the interactions on YouTube.

The data that YouTube receives from you and processes are stored on Google's servers. Most of these servers are located in America. At HTTPS://WWW.GOOGLE.COM/ABOUT/DATACENTERS/LOCATIONS/?HL=EN you can see exactly where the Google data centres are located. Your data is distributed on the servers. This means that the data can be accessed more quickly and is better protected against manipulation.

Google stores the collected data for different lengths of time. Some data can be deleted at any time, others are automatically deleted after a limited time and some are stored by Google for a longer period of time. Some data (such as elements from "My activity", photos or documents, products) that are stored in your Google Account will remain stored until you delete them.

Even if you're not signed in to a Google Account, you can delete some data associated with your device, browser, or app. Basically, you can manually delete data in your Google Account.With the automatic deletion of location and activity data introduced in 2019, information will be stored for either 3 or 18 months, depending on your decision, and then deleted.

Regardless of whether you have a Google Account or not, you can configure your browser to delete or disable Google cookies. This works in different ways depending on the browser you use. Here, we refer to the general handling and deactivation of cookies in this data protection declaration.

10. Issuu plugin

Our websites use a JavaScript-encoded Flash application (plugin) developed by Issuu Inc., 131 Lytton Ave, Palo Alto, CA 94301, USA (hereafter referred to as Issuu) which allows you to view the catalogues of LD and other marketing materials as an e-publication with “turnable” pages.

Issuu uses cookies, small text files saved onto your computer, which enables it to analyse the usage of the websites. The cookies contain personal data, such as your IP address and information about when and how long you used the sites. The transferral of data can only occur if you have activated JavaScript in your browser. You can prevent the use of cookies by selecting the opt-out option in your browser software, or by installing a JavaScript blocker (e.g. from www.noscript.net).

11. Third-party websites

Our website contains links to external pages whose content is not located on our server. This is because we have a justified interest in enriching and relating our content to others. LD makes no guarantees with regard to such third-party websites and assumes no responsibility with respect to such third-party websites. You should be aware that the owners and operators of such third-party websites may possibly collect, use or disclose personal data in a manner other than that applied by LD. When accessing internet links to third-party websites, you should review the data privacy policies of these third-party websites. You should also be aware of the fact that third-party websites may use cookies. This data protection policy only applies to content stored on our servers.

12. Usage of Google Maps

On our websites we use Google Maps to visually present our location as well as for the generation of route directions. This is a service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA (hereinafter "Google").

When you use Google Maps integrated on our websites, Google stores a cookie on your computer via your browser. Your user settings and data, including your IP address, are processed to display our location and create a route direction. By connecting to Google in this way, Google can determine from which website your request has been sent and to which IP address the directions are to be transmitted. We cannot exclude that Google uses servers in the USA. In general, the cookie is not deleted when you close your browser, but expires after a certain period of time, unless you delete it manually beforehand.

Based on the certification according to the EU-US privacy shield (EU-US PRIVACY SHIELD FRAMEWORK - PARTICIPANT LIST OF GOOGLE) Google guarantees that the EU's data protection regulations will also be observed when processing data in the USA.

The legal basis for the processing of data is Sec. 6 para. 1 lit. f GDPR. Our justified interest is the provision of map material for the user of the websites and thus in the optimisation of the functionality of our websites.

If you do not agree to this processing of your data, it is possible to deactivate the Google Maps service and thus prevent the transfer of data to Google. To do this, you must deactivate the JavaScript function in your browser. However, we would like to point out that in this case you will not be able to use Google Maps or only to a limited extent.

13. Usage of Google reCAPTCHA

We use Google reCAPTCHA (referred to as "reCAPTCHA") on our websites. This service is provided by Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA ("Google"). 

reCAPTCHA is used to check whether the data entered on our websites (such as subscription for our newsletter) has been entered by a human or by an automated program. To do this, reCAPTCHA analyses the behavior of the websites visitor based on various characteristics. This analysis starts automatically as soon as the websites visitor enters the websites. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, how long the visitor has been on the websites, or mouse movements made by the user). The data collected during the analysis will be forwarded to Google. The reCAPTCHA analyses take place completely in the background. Websites visitors are not advised that such an analysis is taking place. 

Based on the certification according to the EU-US privacy shield (EU-US PRIVACY SHIELD FRAMEWORK - PARTICIPANT LIST OF GOOGLE) Google guarantees that the EU's data protection regulations will also be observed when processing data in the USA. 

Data processing is based on Sec. 6 para. 1 lit. f GDPR. The LD has a justified interest in protecting its site from abusive automated crawling and spam.

14. PARTICIPATION IN SURVEYS

LD conducts surveys such as customer satisfaction surveys. Participation in LD surveys is voluntary. We use the services of SurveyMonkey Europe UC, 2 Shelbourne Buildings, Shelbourne Road, Dublin, Ireland to conduct online surveys. The surveys can be completed without providing personal data, so that participants remain anonymous. The following personal data can be provided voluntarily: Surname, name, role, telephone number and email address, in order to contact LD directly. The LD collects, processes and uses the data in surveys for the purposes of evaluation, processing or establishing contact.

The information obtained is used to improve the services and business processes of LD. The legal basis for the processing of data are the corresponding legitimate interests according to Sec. 6 para. 1 lit. f GDPR. The data are not transferred to third parties.

By voluntarily participating in this survey, SurveyMonkey is able to gather information about the device and application that you have used to participate in the survey. This includes the IP address, your operating system version, the device type and information about the system and performance, as well as the browser type. If you use a mobile device to participate in the survey, SurveyMonkey also records the UUID. SurveyMonkey also uses so-called tracking services from third party providers, which in turn use cookies and page tags (also known as web beacons) in order to record usage data and user statistics. We have no control over the scope of the data gathered by SurveyMonkey. 15. ONLINE SEMINARS WITH CLICKMEETING

We also provide online seminars as part of our offer. For this, we use the services of ClickMeeting Sp.z.o.o, Arkońska 6/A4, 80-387 Gdańsk, Poland (hereinafter “ClickMeeting”).

If you would like to register for an online seminar offered by us, we require an email address from you as well as your first name, surname, company and country. We collect this information in the registration form that can be found on our website or is provided via a link so that we can register you for the respective online seminar.

ClickMeeting is responsible for providing the service and the associated data processing. Hence your registration data is transmitted to ClickMeeting in order to conduct an online seminar. The date and the time of registration is also stored during transmission.

Upon participation in an online seminar, the following additional data is collected and stored by ClickMeeting: Date and time of entering and leaving the online seminar room, IP address, proxy server, operating system, Web browser, general location data (not GPS-based), language, time zone. Also data that you may supply under certain circumstances within the course of the chat, or in the case of surveys or evaluations. This data is stored in the ClickMeeting system and can be used by us for statistical purposes and for optimisation of our solutions and products.

On the basis of your registration and participation, we will send you access data for the online seminar, reminders about the online seminar and, if appropriate, further preparatory material to the provided email address. In addition, we use the email address you provided during registration to send online seminar documents, the online seminar recording, certificates or further information about products and services that may interest you on the basis of your registration for, or participation in, the online seminar with us. Naturally, in this respect we comply strictly with the legal requirements. If you do not wish to receive further communication from us you can withdraw at any time. In this respect, you will not incur any charges apart from the transmission costs at the basic tariffs. The legality of your consent to any processing carried out up to the point of your withdrawal remains unaffected by this. The processing of your personal data for the before mentioned purposes is effected on the basis of Art. 6 para. 1 lit. f GDPR and Art. 6 para. 1 lit. b GDPR as well as Sec. 7 para. 3 of the UWG (Unfair Competition Act). Processing is in the legitimate interest of LD or is for the implementation of pre-contractual and contractual measures and the legal requirements of Sec. 7 para. 3 of the UWG (Unfair Competition Act) and serves the purposes that arise from your online seminar enquiry as well as further information about the topic of online seminars.

ClickMeeting uses cookies and other similar technologies to allow performance of the service (for example: access to the online seminar, display of images). The data and information collected by the use of cookies are used by ClickMeeting to compile statistics for our online seminars. In turn, these visitor statistics are used by us to determine the number of registrations and participations and the duration of participation. ClickMeeting does not support the processing of participant data contained in cookies and other similar technology on the consent of the user, but rather on the legitimate legal purpose – they are essential for the provider of an information society service (here: ClickMeeting). This is permitted in accordance with Article 5 (3) of Directive 2002/58/EC of the European Parliament and the Council of 12th July 2002 relating to the processing of personal data and protection of privacy in the electronic communications sector (Data Protection Directive and ePrivacy Directive). This personal data that is collected via cookies is stored by LD and evaluated to optimise the online seminars. This personal data is not transmitted to third parties.

The online seminar contents transferred within the course of the online seminar are recorded and stored in the ClickMeeting solution.

We use the option of supplying online seminars to communicate and visually illustrate the possible applications, properties and functions of our products and solutions to customers, prospective customers and partners, and also to explain their benefits. In the aforementioned data processing operations and the named purposes of processing, our legitimate interest is based on the legal foundation of Art. 6 Para. 1 lit. f GDPR.

III. Who receives or has access to your personal data?

1. Dispatch service providers

We transmit your personal data only to dispatch and delivery companies that assist us in delivering your orders to you. These dispatch and delivery companies are third parties in accordance with applicable data protection law. For the delivery, we transmit your name, the name of the school/institute/company, the address and your telephone number for potential questions. The data is only transmitted and processed to dispatch your order.

2. Use of service providers

We utilise service providers who help us operate the websites and online shops. For instance, we utilise hosting services, customer management tools, website analysing tools and marketing software from our service providers and use IT support service providers. These service providers are contract processors in terms of data protection laws who only process the provided personal data on our behalf and in accordance with our instructions. We also contractually obligate our service providers to take sufficient technical and organisational measures to ensure the protection of your personal data. We regularly check to ensure that these measures are complied with. If our service providers are not located within the EU/the European Economic Area, we have established a reasonable level of data protection at our service providers (via EU - US Privacy Shield Frameworks certification or EU standard contract clauses).

1. What are cookies?

We use so called cookies on our websites. These are small text files that are downloaded and saved to the device you are using to surf on our website (e.g. a computer or smartphone, collectively referred to as “computer”) when you access a website. By using cookies, LD can provide the users of our websites with user-friendly services that wouldn’t be possible without cookies in place, e.g. optimising information and offers on our websites for the user. You therefore do not have to enter your login data every time you visit the websites, for example, and our online shops remember articles you placed in your virtual shopping cart because the saved cookies deals with that. That allows us to optimally design our websites to meet your needs and improve your user experience even more.

2. What kinds of cookies does LD use?

For instance, these cookies can be used to save your user data in our Download Center. In addition, they can be used to offer interactive information such as viewing our virtual catalogue or product videos. This also includes cookies from the software solution we use, HubSpot. This allows us to show you targeted content which actually interests you based on your product interests so that you aren’t overloaded with unnecessary information. It also allows us to provide extended download functions.

These cookies are saved on the basis of Sec. 6 para. 1 lit. f GDPR. The LD has a justified interest in saving the cookies for the technically smooth and optimised presentation of all services to its users and to optimise the content and advertising on the websites.

  • Analysis cookies
These cookies collect data about how the site is used, such as which subpages are visited most. These cookies provide LD analytical data about the performance of the site and insights into how LD can improve the site.

Google Analytics and HubSpot cookies are saved on the basis of Sec. 6 para. 1 lit. f GDPR. The LD has a justified interest in the analysis of the user behaviour to optimise both its online offer and its advertisements.

3. How can I allow, prohibit and manage cookies?

You can prevent the placement of cookies by our websites at any time via the relevant settings in the browser and thus permanently prohibit their use. Already saved cookies can be deleted via your browser or other software programmes at any time. This is possible in all conventional Internet browsers. If you deactivate cookies in your Internet browser, not all of the functions of our websites will be fully available to you.

You consent to the use of cookies if you continue surfing on the site after we have notified you of the use of cookies.

V. How does Google Analytics’ web analysis work (with anonymisation function)?

LD has integrated the Google Analytics component (with anonymisation function) into its websites. Google Analytics is a web analysis service from Google Inc. (“Google”).

What is a web analysis?

Web analysis refers to the gathering, collection and evaluation of data about the behaviour of website visitors. A web analysis service records data about, among other things, from which website a person accessed a website, on which subpages of the website were accessed or how often and for how long a subpage was viewed. Google uses the collected data and information to, among other things, evaluate the use of our websites to compile online reports which present the activities on our websites and to provide additional services related to the use of our websites. A web analysis is primarily used to optimise a website and for cost-benefit analysis of online advertising.

The operating company of the Google Analytics component is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

Google Analytics places a cookie on the IT system you are using (e.g. your computer). You can read more about what cookies are here. Placing the cookie allows Google to perform an analysis of the use of our websites. By opening individual pages on these websites, the respective Google Analytics component will automatically have the Internet browser on the relevant person’s IT system to transmit data to Google for the purpose of online analysis. During this technical procedure, Google will receive personal information such as the person’s IP address, which Google uses to, among other things, track the origin of the visitors and clicks.

We use IP anonymisation

Every time our websites are visited, this personal data, including the IP address of the Internet connection used, is transmitted to a Google server in the United States of America and saved there by Google. Google may pass personal data collected via the technical procedure on to third parties under certain circumstances.

LD uses the “_gat._anonymizeIp” suffix for the web analysis via Google Analytics. Using this suffix, so-called IP masking, on our websites, Google shortens and anonymises your IP address if our websites are accessed from a European Union member state or from another state party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of these websites, Google will use this information to evaluate your use of the websites to compile reports about the activities on the websites and to provide services to the website operator related to the use of the website and the Internet. The IP address transmitted by your browser in the framework of Google Analytics will not be combined with other data from Google. Google Analytics cookies are saved on the basis of Art. 6(1) lit. f of the GDPR. The website operator has a justified interest in the analysis of the user behaviour to optimise both its online offer and its advertisements.

How do you prevent the cookies from being saved?

You can prevent cookies from being saved via your browser’s settings; however, please note that if you do so, you may not be able to fully utilise all of the functions on our websites.

You can prevent the placement of cookies by our websites at any time via the relevant settings in the browser and thus permanently prohibit their use. Setting the browser settings in this manner also prevents Google from placing a cookie on your IT system. A cookie placed by Google Analytics can also be deleted at any time via the browser or another software program.

You also have the option of objecting to the collection of the data generated by Google Analytics cookies related to the use of this website (including your IP address) and the processing of this data by Google and prevent this from occurring. VI. How long do we process your personal data?

We follow the principles of data avoidance and data minimisation. We therefore only save your personal data as long as it is required to achieve the objective specified here or as is required by the European bodies issuing guidelines and directives or another legislative body in laws or regulations to which LD is subject. Once the purpose no longer applies or these periods are over, the relevant data is routinely blocked or deleted in accordance with the relevant statutory regulations.

This includes the processing purpose and how long your data will presumably be stored and where we obtained your data. You also have the right to receive the data in a structured, conventional and machine-readable format.

Right to rectification, erasure (right to be forgotten), restriction of processing and object according to Sec. 16, 17, 18 and 21 GDPR

You also have the right to correct incorrect personal data or, with the exception of the mandatory data storage for the purpose of processing the order or fulfilling a legal obligation to which LD is subject, block or delete your personal data. You also have the right to demand the limitation of the processing if this is not required to fulfil the contract or to object to the processing.

Right to data portability according to Sec. 20 GDPR

You have the right to have the data we process automatically on the basis of your consent declaration or to fulfil a contract surrendered to you or a third party in a conventional, machine-readable format. If you demand a direct transmission of the data to another responsible party, this will only be done if technically feasible.

Right to not be subject to an automated individual decision-making, including profiling according to Sec. 22 GDPR

Under certain circumstances, you can continue to assert your rights with respect to automated decisions, meaning not being subject to a differentiation based exclusively on automated processing, including profiling.

Right to object a data protection consent declaration according to Sec. 21 GDPR

Many data processing procedures are only possible with your express consent. You can revoke already issued consent declarations at any time. An informal email to us is sufficient. The legality of the data processing procedures prior to the revocation remains unaffected by the revocation.

Right to lodge a complaint with a supervisory authority

In the event of data protection violations, the affected party is entitled to file a claim with the competent supervisory authority. The competent supervisory authority for data protection matters is the State Data Protection Officer of the state in which our company is headquartered. The competent supervisory authority for North Rhine-Westphalia is the North Rhine-Westphalia State Officer for Data Protection and Freedom of Information.
